1. About these terms

These terms apply when you use Round to order food or book a ride, on the Round website (roundtown.co.nz and order.roundtown.co.nz), the Round app, the ordering pages Round runs for local businesses (for example order.thebestbites.co.nz), our phone line or WhatsApp. By placing an order or booking you agree to them. Our privacy policy and refund and cancellation policy are part of these terms.

Round is run from Waiuku, New Zealand. "Round", "we" and "us" mean the Round business; "you" means the person ordering or riding.

2. Your rights under New Zealand law

Nothing in these terms takes away your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you are buying for personal or household use, those guarantees apply whatever these terms say: food must be of acceptable quality and as described, and services must be carried out with reasonable care and skill and within a reasonable time. If a business buys through Round for business purposes, the Consumer Guarantees Act does not apply to that order, to the extent the law allows.

3. Who you are buying from

  • Food and drink is sold and prepared by the business you order from. That business is responsible for the food itself, including food safety, allergens and what is in each item, and holds its own registration under the Food Act 2014.
  • Delivery is arranged by Round and carried out by an independent driver, or by the business's own driver where the business delivers itself.
  • Rides are provided by independent drivers who hold a passenger (P) endorsement, through Round.

Round takes your order and payment on the business's behalf and passes the order straight to them.

4. Allergies and dietary needs

Menu descriptions come from each business. If you have an allergy or intolerance, contact the business before you order. Kitchens handle many ingredients, so a business may not be able to guarantee an item is free from any allergen.

5. Prices, fees and payment

  • Prices are in New Zealand dollars and include GST.
  • Prices on Round's own pages can be higher than in store, because some businesses add a small amount to cover Round's costs. The price you see before you pay is the price you pay.
  • Deliveries carry a delivery fee based on distance, shown before you pay. Free delivery only applies when an offer says so.
  • Payment is taken when you order, through Stripe. We never see or store your full card number.
  • If a price changes while you are ordering, we show you the new total before you pay. You are never charged a price you were not shown.
  • Offers and discount codes apply as described in the offer, one use per order unless stated, and cannot be swapped for cash.

6. Placing an order

  • Your order is a request until the business accepts it. Once accepted you get a confirmation with a ready or arrival time.
  • Times are estimates. Busy nights, weather and traffic can change them; we will tell you if an order is running late.
  • Please give an accurate address, phone number and any delivery instructions. If a driver cannot find you or reach you, they may leave the order in a safe place or return it, and a refund may not be possible (see the refund policy).
  • For pickup orders, collect from the pickup spot shown in your confirmation. Pickup spots can change from night to night.
  • Some items, such as alcohol or age-restricted products, can only be sold to people old enough to buy them, and the driver or business may ask for ID.

7. Rides

  • Fares are shown before you book. Waiting time, changes to the trip or cleaning after damage or mess may cost extra, and we will tell you if they apply.
  • Wear a seatbelt, keep to the number of seats in the car, and use an approved child restraint for children as the law requires.
  • Drivers may refuse or end a ride if a passenger is abusive, unsafe or damages the vehicle.

8. Treating people well

Be respectful to drivers, business staff and our team. We may refuse service or close an account for abuse, threats, harassment, fraud, misuse of offers or chargebacks made in bad faith.

9. Accounts

You need to be 16 or over to use Round. Keep your login private and tell us if you think someone else has used your account. You can delete your account any time (see the privacy policy).

10. Reviews and messages

Reviews must be honest and about your own experience. We may hide reviews that are abusive, fake, off topic or include someone's personal details. Calls to our number are answered by Ari, our AI assistant, and are recorded.

11. Our responsibility to you

We will provide our service with reasonable care and skill. Where the law allows, Round is not responsible for loss caused by something outside our reasonable control, or for indirect loss such as loss of profits, and our total responsibility for an order is limited to what you paid for that order. None of this limits your rights under the Consumer Guarantees Act or any other right that cannot be excluded by law.

12. Problems and complaints

Tell us as soon as you can through feedback and complaints, WhatsApp or hello@roundtown.co.nz. We aim to reply within two working days. If we cannot sort it out, you can contact the Disputes Tribunal (disputestribunal.govt.nz) or Consumer Protection (consumerprotection.govt.nz).

13. Changes to these terms

We may update these terms. The version on this page when you order is the one that applies to that order.

14. New Zealand law

These terms are governed by New Zealand law, and New Zealand courts and tribunals deal with any dispute.
